IB Recruitment – Candidate Terms and Conditions

These Candidate Terms and Conditions ("Terms") govern your use of the recruitment services offered by IB Recruitment ("we", "us", or "our") through our website located at www.ibrecruitment.com ("Website"). By registering with us, submitting your CV, or otherwise engaging with our recruitment services, you ("Candidate", "you", or "your") agree to be bound by these Terms.

1. Our Services

1.1 IB Recruitment operates as an employment agency, providing professional recruitment services to facilitate introductions between candidates and prospective employers in the energy, infrastructure, and real estate sectors.

1.2 We do not guarantee employment, interviews, or specific remuneration levels. All decisions regarding hiring are at the sole discretion of the employer.

2. Candidate Obligations

2.1 You warrant that all information, documentation, and representations you provide (including your CV, cover letters, references, qualifications, and identification) are accurate, up-to-date, and not misleading.

2.2 You agree to inform us promptly of any material changes to your employment status, availability, or professional qualifications.

2.3 You shall not engage in conduct that may harm our reputation or the integrity of the recruitment process.

3. Data Protection and Confidentiality

3.1 Your personal data will be processed in accordance with the UK General Data Protection Regulation (UK GDPR) and our Privacy Policy. We will only share your personal data with prospective employers or clients with your prior consent.

3.2 You agree to keep confidential all information regarding job opportunities, employers, and recruitment processes disclosed to you via IB Recruitment.

4. No Fee to Candidates

4.1 IB Recruitment does not charge candidates for registration or for the provision of recruitment services.

4.2 You must report to us immediately if any third party, purporting to act on our behalf, requests payment in exchange for employment opportunities.

5. Use of the Website

5.1 You agree to use the Website lawfully and not to upload or transmit any harmful content, viruses, or any materials that infringe third-party rights.

5.2 We reserve the right to suspend or terminate your access to the Website at our sole discretion if we believe you have breached these Terms.

6. Limitation of Liability

6.1 While we strive to match you with suitable opportunities, we are not liable for:

  • Any loss, damage, or delay arising from your use of our services.

  • Decisions made by employers or third parties.

  • Any failure or interruption of the Website.

6.2 Our liability is limited to the fullest extent permitted by law.

7. Termination

7.1 You may request to withdraw from our candidate database at any time by contacting us at info@ibrecruitment.com.

7.2 We reserve the right to terminate our engagement with you at any time and without notice in the event of breach or misconduct.

8. Governing Law and Jurisdiction

8.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.

8.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Amendments

We reserve the right to modify these Terms from time to time. Changes will be posted on our Website and shall take effect from the date of publication. Continued use of our services constitutes acceptance of the revised Terms.

10. Additional Terms for Temporary and Contract Workers

10.1 Scope of Engagement
If you are introduced by us for temporary or fixed-term contract assignments, you may be engaged either directly by the client, via an umbrella company, or through IB Recruitment acting as an Employment Business (as defined in the Conduct of Employment Agencies and Employment Businesses Regulations 2003).

10.2 Right to Work
Before any assignment begins, you must provide satisfactory evidence of your legal right to work in the UK (or the jurisdiction where the assignment will take place). Failure to do so will preclude engagement.

10.3 Timesheets and Payment
Where applicable, you must submit timesheets in a timely and accurate manner, verified by the client. Payment will be processed only upon receipt and approval of verified timesheets, in accordance with the agreed pay schedule.

10.4 Conduct and Performance
You must adhere to all reasonable instructions given by the client during the assignment and comply with any applicable health and safety or workplace policies.

10.5 Early Termination
Either party may terminate an assignment subject to the notice period (if any) outlined in the assignment confirmation. Misconduct, breach of terms, or failure to meet expectations may result in immediate termination.

11. Additional Terms for Executive-Level Candidates

11.1 Confidential Searches
Executive searches may be conducted on a confidential basis. You agree to maintain strict confidentiality regarding any executive role, board appointment, or senior opportunity discussed with you.

11.2 Due Diligence and Referencing
By engaging with IB Recruitment for senior roles, you consent to us undertaking enhanced referencing and due diligence, including directorship history, credit checks, or regulatory clearances, subject to your prior written consent.

11.3 Remuneration and Package Negotiations
We may, with your agreement, act as an intermediary in negotiating remuneration packages, equity incentives, or relocation terms with prospective employers. You acknowledge that final terms are subject to employer discretion and offer letters.

11.4 Non-Circumvention
You agree not to approach, apply to, or solicit roles with clients to whom you have been introduced by IB Recruitment for a period of 12 months from the date of introduction, unless agreed in writing.

11.5 Board and Non-Executive Appointments
If we introduce you for a board or non-executive director appointment, additional governance and fiduciary obligations may apply, and you will be expected to meet the applicable regulatory or listing standards required for such roles.

12. Employment Termination – Legal Representation Disclaimer

12.1 Recruitment Agent, Not Legal Counsel
IB Recruitment operates as a recruitment agency and not as a legal advisory service. We are not authorised to provide legal advice, represent individuals in employment disputes, or act on behalf of any candidate in legal proceedings relating to termination of employment.

12.2 Dismissal by Employer
In the event that you are dismissed, made redundant, or otherwise terminated by an employer to whom you were introduced by IB Recruitment, you acknowledge and agree that:

  • IB Recruitment bears no liability for the employer's conduct, contractual decisions, or the circumstances surrounding your termination; and

  • All employment-related matters, including disciplinary action, grievance procedures, or claims for unfair dismissal, lie solely between you and the employer.

12.3 Recommendation to Seek Legal Advice
We strongly recommend that any candidate who believes they have been wrongfully or unfairly dismissed seek independent legal advice from a qualified employment solicitor. Legal representation is particularly important where issues involve:

  • Unfair dismissal under the Employment Rights Act 1996

  • Discrimination under the Equality Act 2010

  • Redundancy rights, notice periods, or settlement agreements

  • Breach of contract or failure to pay statutory entitlements (e.g. notice pay, holiday pay)

IB Recruitment accepts no responsibility for any loss, financial or otherwise, suffered by candidates arising from an employment dispute, termination, or legal process following placement. We do not participate in litigation, settlement discussions, or appeals relating to such matters.
